REGULATIONS ON THE MINISTRY OF EDUCATION AND SCIENCE OF THE RUSSIAN FEDERATION

I. General provisions

1. The Ministry of Education and Science of the Russian Federation (Ministry of Education and Science of Russia) is a federal executive body that carries out the functions of developing and implementing state policy and legal regulation in the field of education, scientific, scientific, technical and innovative activities, nanotechnology, and the development of federal science centers and high technologies, state scientific centers and science cities, intellectual property (with the exception of legal regulation of issues related to control, supervision and provision of public services in the field of legal protection of inventions, utility models, industrial designs, programs for electronic computers, databases and topologies of integrated circuits, including those included in the unified technology, trademarks, service marks, appellations of origin of goods), in the field of education, guardianship and trusteeship of minor citizens, social support and social protection of students of educational organizations, in the field of youth policy, as well as functions for the provision of public services and management of state property in the field of education, upbringing, scientific, scientific-technical and innovative activities, including the activities of federal centers of science and high technology, state scientific centers, unique scientific stands and installations, federal centers of collective use, leading scientific schools, a new generation national research computer network and information support for scientific, scientific, technical and innovative activities.

2. The Ministry of Education and Science of the Russian Federation coordinates and controls the activities of the Federal Service for Supervision in Education and Science and the Federal Agency for Youth Affairs, which are under its jurisdiction.

3. The Ministry of Education and Science of the Russian Federation is guided in its activities by the Constitution of the Russian Federation, federal constitutional laws, federal laws, acts of the President of the Russian Federation and the Government of the Russian Federation, international treaties of the Russian Federation, as well as these Regulations.

4. The Ministry of Education and Science of the Russian Federation carries out its activities directly and through organizations subordinate to it in interaction with other federal executive authorities, executive authorities of constituent entities of the Russian Federation, local government bodies, public associations and other organizations.

II. Authority

5. The Ministry of Education and Science of the Russian Federation exercises the following powers:

5.1. submits to the Government of the Russian Federation draft federal laws, regulatory legal acts of the President of the Russian Federation and the Government of the Russian Federation and other documents that require a decision from the Government of the Russian Federation on issues related to the established sphere of jurisdiction of the Ministry and the sphere of jurisdiction of the federal service and federal service subordinate to it agency, to the activities of the Higher Attestation Commission under the Ministry of Education and Science of the Russian Federation, as well as a draft work plan and forecast indicators for the activities of the Ministry;

5.2. on the basis of and in pursuance of the Constitution of the Russian Federation, federal constitutional laws, federal laws, acts of the President of the Russian Federation and the Government of the Russian Federation, independently adopts the following regulatory legal acts:

5.2.1. lists of professions, specialties and areas of training indicating the qualifications assigned to the relevant professions, specialties and areas of training, the procedure for the formation of these lists;

5.2.2. a list of professions of workers, positions of employees for which vocational training is carried out, indicating the qualifications assigned to the corresponding professions of workers, positions of employees;

5.2.3. on the compliance of individual professions, specialties and areas of training specified in the new lists of professions, specialties and areas of training with the professions, specialties and areas of training indicated in the previous lists of professions, specialties and areas of training;

5.2.4. a list of professions, specialties and areas of training, the implementation of educational programs for which is not allowed using exclusively e-learning and distance learning technologies;

5.2.5. the procedure for the use of e-learning and distance learning technologies by organizations engaged in educational activities in the implementation of educational programs;

5.2.6. the procedure for organizing and carrying out educational activities according to relevant educational programs of various levels and (or) orientations or for the corresponding type of education;

5.2.7. the procedure for developing exemplary basic educational programs, conducting their examination and maintaining a register of exemplary basic educational programs, features of the development, conducting examination and inclusion in such a register of exemplary basic professional educational programs containing information constituting a state secret, and exemplary basic professional educational programs in the field of information security;

5.2.8. regulations on the practice of students mastering basic professional educational programs and its types;

5.2.9. the procedure for the formation of a federal list of textbooks recommended for use in the implementation of educational programs of primary general, basic general, and secondary general education that have state accreditation, including the criteria and procedure for the examination of textbooks, the form of an expert opinion, as well as the grounds and procedure for excluding textbooks from the specified federal list;

5.2.10. the procedure for selecting organizations that produce textbooks that are allowed to be used in the implementation of educational programs of primary general, basic general, secondary general education that have state accreditation, and a list of such organizations;

5.2.11. standard provisions on educational and methodological associations in the education system;

5.2.12. the procedure for the formation and functioning of innovation infrastructure in the education system (including the procedure for recognizing an organization as a federal innovation platform), a list of federal innovation platforms;

5.2.13. list of indicators, criteria and frequency of assessing the effectiveness of the implementation of development programs of national research universities;

5.2.14. the procedure for the creation by professional educational organizations and educational organizations of higher education of departments and other structural units that provide practical training for students, on the basis of other organizations operating in the profile of the relevant educational program;

5.2.15. performance indicators of the educational organization subject to self-examination and the procedure for its conduct;

5.2.16. samples of student ID and grade book;

5.2.17. procedure and grounds for granting academic leave to students;

5.2.18. cases and procedure for the transition of students from paid to free education;

5.2.19. the procedure for transferring a student to another educational organization implementing an educational program of the appropriate level;

5.2.20. procedure and conditions for the transfer of students in the event of termination of the activities of an organization carrying out educational activities, cancellation of the corresponding license, deprivation of its state accreditation for the relevant educational program or expiration of the state accreditation for the relevant educational program to other organizations carrying out educational activities for educational programs of the appropriate level and direction;

5.2.21. the procedure and conditions for the transfer of students in the event of suspension of a license, suspension of state accreditation in full or in relation to individual levels of education, enlarged groups of professions, specialties and areas of training to other organizations carrying out educational activities in basic educational programs of the appropriate level and focus that have state accreditation ;

5.2.22. the procedure for assigning a state academic scholarship and (or) a state social scholarship to students studying full-time at the expense of budgetary allocations from the federal budget, as well as requirements for students studying full-time at the expense of budgetary appropriations from the federal budget who are awarded a state academic scholarship;

5.2.23. the procedure for awarding state scholarships to graduate students, residents, and assistant trainees studying full-time at the expense of federal budget allocations;

5.2.24. the procedure for paying scholarships to students of preparatory departments of federal state educational organizations of higher education who study at the expense of budgetary allocations from the federal budget;

5.2.25. the procedure for applying disciplinary measures to students and removing them from students;

5.2.26. the procedure for granting teaching staff long-term leave for a period of up to one year;

5.2.27. features of the working hours and rest hours of teaching staff of organizations carrying out educational activities;

5.2.28. the procedure for certification of teaching staff of organizations carrying out educational activities (in agreement with the Ministry of Labor and Social Protection of the Russian Federation);

5.2.29. sample forms of education agreements;

5.2.30. the procedure for admission to study in educational programs of each level of education (including the procedure for admission of foreign citizens and stateless persons, the maximum number of educational institutions of higher education to which an applicant for study in bachelor's or specialty programs has the right to submit applications at the same time, and the number of specialties and areas of training in which he has the right to participate in the competition);

5.2.31. features of conducting entrance tests for persons with disabilities;

5.2.33. a list of entrance tests for admission to study in the main professional educational programs of each level;

5.2.34. a list of additional entrance tests for admission to educational programs of higher education;

5.2.35. forms of state final certification;

5.2.36. the procedure for conducting state final certification for relevant educational programs of various levels and in any forms (including requirements for the use of teaching and educational means, communication means when conducting state final certification, requirements for persons involved in conducting state final certification, the procedure for submission and consideration appeals, changes and (or) cancellation of the results of the state final certification);

5.2.37. forms of state final certification for students in educational programs of secondary general education in special closed educational institutions, as well as in institutions executing punishment in the form of imprisonment, for students receiving secondary general education as part of the development of educational programs of secondary vocational education, in including educational programs of secondary vocational education, integrated with the main educational programs of basic general and secondary general education, for students with disabilities or for students with disabilities and people with disabilities in educational programs of secondary general education;

5.2.38. the procedure for accreditation of citizens as public observers;

5.2.39. samples of documents on education, documents on education and qualifications (with the exception of samples of diplomas on completion of residency or assistantship-internship) and appendices to them, a description of these documents and appendices, the procedure for filling out, recording and issuing these documents and their duplicates;

5.2.40. a sample certificate of training and the procedure for its issuance to persons with disabilities (with various forms of mental retardation), who do not have basic general and secondary general education and who studied in adapted basic general education programs;

5.2.41. federal state educational standards;

5.2.42. federal state educational standards for residency programs (in agreement with the Ministry of Health of the Russian Federation);

5.2.43. federal state educational standards for assistantship-internship programs (in agreement with the Ministry of Culture of the Russian Federation);

5.2.44. federal state educational standards for educational programs of secondary vocational education and higher education in the field of training specialists for civil aviation personnel, ship crew members in accordance with international requirements, as well as in the field of training railway transport workers directly related to train movement and shunting work (according to agreement with the Ministry of Transport of the Russian Federation);

5.2.45. the procedure for forming national teams of the Russian Federation to participate in international Olympiads in general education subjects;

5.2.46. the procedure for selecting federal state educational organizations of higher education, in the preparatory departments of which training is carried out at the expense of budgetary allocations from the federal budget, and the list of these organizations;

5.2.47. the procedure for conducting Olympiads for schoolchildren (including establishing the list and levels of Olympiads for schoolchildren, including criteria for determining the levels of these Olympiads, samples of diplomas of winners and prize-winners of Olympiads for schoolchildren, the procedure for granting special rights to winners and prize-winners of Olympiads for schoolchildren upon admission to educational organizations of higher education for study programs undergraduate and specialist programs in specialties and (or) areas of training corresponding to the profile of the school Olympiad);

5.2.48. the procedure and timing of the All-Russian Olympiad for schoolchildren, including the list of general education subjects in which it is held, the final results of its conduct, samples of diplomas of winners and prize-winners of the All-Russian Olympiad for schoolchildren;

5.2.49. the procedure for creating in educational organizations implementing educational programs of higher education, scientific organizations and other organizations carrying out scientific (research) activities, laboratories carrying out scientific (research) and (or) scientific and technical activities;

5.2.50. the procedure for the creation by educational organizations implementing educational programs of higher education, in scientific organizations and other organizations carrying out scientific (research) activities, departments carrying out educational activities;

5.2.51. the procedure for developing additional professional programs containing information constituting state secrets and additional professional programs in the field of information security (in agreement with the Federal Security Service of the Russian Federation and the Federal Service for Technical and Export Control);

5.2.52. the procedure for selecting foreign citizens for training within the quota established by the Government of the Russian Federation, as well as the requirements for them;

5.2.53. procedure and criteria for selecting federal state educational organizations, in the preparatory departments and preparatory faculties of which foreign citizens entering within the quota established by the Government of the Russian Federation have the right to study in additional general education programs that ensure the preparation of foreign citizens for mastering professional educational programs in Russian for account of budgetary appropriations of the federal budget, and a list of specified educational organizations;

5.2.54. the procedure for investigating and recording accidents with students during their stay in an organization carrying out educational activities (in agreement with the Ministry of Health of the Russian Federation);

5.2.55. requirements for the development of additional general education programs that ensure the preparation of foreign citizens for the development of professional educational programs in Russian;

5.2.56. features of the organization of educational activities for students with disabilities (together with the Ministry of Labor and Social Protection of the Russian Federation);

5.2.57. the procedure for organizing and carrying out educational activities in educational organizations with special names “cadet school”, “cadet (naval cadet) military corps” and “Cossack cadet corps”;

5.2.58. form of license to carry out educational activities, form of annex to the license and technical requirements for these documents;

5.2.59. application forms for state accreditation and documents attached to it, as well as requirements for their completion and execution;

5.2.60. qualification requirements for experts, requirements for expert organizations, the procedure for attracting and selecting experts and expert organizations to conduct accreditation examinations, the procedure for their accreditation (including the procedure for maintaining a register of experts and expert organizations);

5.2.61. forms of the certificate of state accreditation of educational activities and attachments to it, as well as technical requirements for these documents;

5.2.62. a list of documents attached to the application for recognition of a foreign education and (or) foreign qualification, the procedure and timing of the examination of a foreign education and (or) foreign qualification, as well as the form of a certificate of recognition of a foreign education and (or) foreign qualification and technical requirements for it ;

5.2.63. the procedure for carrying out the activities of school sports clubs and student sports clubs (including in the form of public associations) that are not legal entities;

5.2.64. on the procedure for filling positions of scientific and pedagogical workers;

5.2.65. on the procedure for certification of employees holding positions of scientific and pedagogical workers;

5.2.66. the procedure and timing of certification of candidates for the position of head and head of an educational organization subordinate to the Ministry;

5.2.67. regulations on the psychological, medical and pedagogical commission and the procedure for conducting a comprehensive psychological, medical and pedagogical examination of children (in agreement with the Ministry of Health of the Russian Federation);

5.2.68. the procedure for maintaining a state data bank on children left without parental care and monitoring its formation and use;

5.2.69. on the legal basis for assessing the qualifications of specialists in a scientific organization and the criteria for this assessment;

5.2.70. on the legal basis for assessing the qualifications of scientific workers of a scientific organization and the criteria for this assessment;

5.2.71. on the duration of working hours (standard hours of teaching work per wage rate);

5.2.72. the procedure for recognizing documents from foreign states on academic degrees and academic titles on the territory of the Russian Federation and issuing relevant certificates;

5.2.73. forms of certificates of recognition of documents of foreign states on academic degrees and academic titles on the territory of the Russian Federation, technical requirements for them;

5.2.74. normative legal acts on issues of the established scope of activity of the Ministry and federal services and federal agencies subordinate to the Ministry, with the exception of issues the legal regulation of which in accordance with the Constitution of the Russian Federation, federal constitutional laws, federal laws, acts of the President of the Russian Federation and the Government of the Russian Federation is carried out exclusively by federal constitutional laws, federal laws, regulatory legal acts of the President of the Russian Federation and the Government of the Russian Federation;

5.3. in accordance with the procedure established by the legislation of the Russian Federation, places orders and concludes government contracts, as well as other civil contracts for the supply of goods, performance of work, provision of services to meet the needs of the Ministry, as well as for carrying out research, development and technological work for other state needs in the established field of activity;

5.4. generalizes the practice of applying the legislation of the Russian Federation, analyzes the implementation of state policy and prepares proposals for improving the legislation of the Russian Federation in the established field of activity;

5.4.1. develops and implements measures to develop competition in product markets, including the implementation of relevant departmental target programs in the established field of activity;

5.5. carries out:

5.5.1. in the manner and within the limits determined by federal laws, acts of the President of the Russian Federation and the Government of the Russian Federation, the powers of the owner in relation to federal property necessary to ensure the performance of the functions of federal government bodies in the field of activity established by paragraph 1 of these Regulations, including property transferred to the federal state organizations, federal state unitary enterprises and state-owned enterprises subordinate to the Ministry;

5.5.2. powers and functions of the founder in relation to subordinate organizations;

5.5.3. functions of the main manager and recipient of federal budget funds allocated for the maintenance of the Ministry and the implementation of the functions assigned to it;

5.5.4. functions of the state customer of federal target programs and projects in the established field of activity;

5.5.5. formation of instrumentation, technological and information base for the development of nanoindustry;

5.5.6. monitoring of scientific, technical and production potential in the field of nanotechnology;

5.5.7. establishing targeted admission quotas for higher education in the amount of target numbers established for the next year for the admission of citizens to study at the expense of budgetary allocations from the federal budget for each level of higher education, each specialty and each area of training in relation to organizations, the functions and powers of the founder of which are performed by the Ministry;

5.5.8. establishing organizations that are granted the right to maintain a register of exemplary basic educational programs;

5.5.9. organizational and technical support for the activities of the Higher Attestation Commission under the Ministry of Education and Science of the Russian Federation;

5.5.10. issuing in the prescribed manner, at the request of educational organizations of higher education, educational organizations of additional professional education and scientific organizations, permissions to create on their basis councils for the defense of dissertations for the academic degree of Candidate of Sciences, for the academic degree of Doctor of Science, determination and change of the composition of these councils, determining the lists of specialties for which these councils are granted the right to accept dissertations for defense;

5.5.11. recognition of documents of foreign states on academic degrees and academic titles on the territory of the Russian Federation, issuance of certificates of recognition of documents of foreign states on academic degrees and academic titles on the territory of the Russian Federation;

5.5.12. coordination, in accordance with its powers, of fundamental scientific research carried out at the expense of the federal budget;

5.5.13. coordination of activities in the field of education of federal government bodies, executive authorities of constituent entities of the Russian Federation and other subjects of the education system;

5.5.14. organizing monitoring of the education system;

5.5.15. ensuring monitoring in the education system at the federal level;

5.5.16. organizing a pedagogical examination of draft normative legal acts and normative legal acts relating to issues of training and education;

5.6. organizes the reception of citizens, ensures timely and complete consideration of oral and written requests from citizens, making decisions on them and sending responses within the period established by the legislation of the Russian Federation;

5.7. ensures, within its competence, the protection of information constituting state secrets;

5.8. ensures mobilization preparation of the Ministry, as well as control and coordination of the activities of the federal service and federal agency under its jurisdiction for their mobilization preparation;

5.9. carries out the organization and management of civil defense in the Ministry;

5.10. organizes additional professional education for federal civil servants of the Ministry;

5.11. interacts in the prescribed manner with government authorities of foreign states and international organizations in the established field of activity;

5.12. carries out, in accordance with the legislation of the Russian Federation, work on the acquisition, storage, recording and use of archival documents generated in the course of the activities of the Ministry;

5.13. carries out approval of the appointment to the position of heads of executive authorities of the constituent entities of the Russian Federation, exercising the powers of the Russian Federation in the field of education, transferred for implementation to state authorities of the constituent entities of the Russian Federation;

5.14. coordinates the creation and liquidation of branches of federal state educational organizations of higher education, in relation to which the Ministry does not exercise the functions and powers of the founder;

5.15. develops and implements measures to support small and medium-sized businesses aimed at their development, including the development and implementation of relevant departmental target programs in the established field of activity;

5.16. carries out the development of methodological materials on issues of guardianship and trusteeship in relation to minor citizens;

5.17. submits to the Government of the Russian Federation, on the proposal of the federal executive body exercising the functions of control and supervision in the field of education, proposals to withdraw the powers of the Russian Federation in the field of education, transferred for implementation by state authorities of the constituent entities of the Russian Federation, from the state authorities of the constituent entities of the Russian Federation;

5.18. develops forecasts for personnel training, requirements for personnel training based on the forecast of labor market needs;

5.19. issues permits to foreign and Russian applicants to conduct marine scientific research in the internal sea waters and territorial sea of the Russian Federation, in its exclusive economic zone and on its continental shelf in agreement with the federal executive authorities, determined respectively by the President of the Russian Federation and the Government of the Russian Federation;

5.20. provides support to socially oriented non-profit organizations that carry out activities in the field of education and science in accordance with their constituent documents, forms and maintains a federal register of socially oriented non-profit organizations that are recipients of such support;

5.21. carries out organizational and methodological support and coordination of activities to prevent neglect and juvenile delinquency carried out by social institutions, clubs and other institutions under the jurisdiction of the Ministry;

5.22. creates, in cooperation with public organizations and movements representing the interests of youth, conditions for ensuring a healthy lifestyle, moral and patriotic education of youth, and the realization of professional opportunities for youth;

5.23. provides assistance to children's and youth public associations, social institutions, foundations and other institutions and organizations whose activities are related to the implementation of measures to prevent neglect and juvenile delinquency;

5.24. carries out, in accordance with the established procedure, on behalf of the Russian Federation, the disposal of rights to intellectual property objects and other scientific and technical results created at the expense of the federal budget by order of the Ministry;

5.25. carries out an economic analysis of the activities of subordinate state unitary enterprises and approves the economic indicators of their activities, conducts audits of financial and economic activities and use of the property complex in subordinate organizations;

5.26. organizes congresses, conferences, olympiads, seminars, exhibitions and other events in the established field of activity;

5.27. performs other functions in the established field of activity, including the management of state property and the provision of public services, if such functions are provided for by federal laws, regulatory legal acts of the President of the Russian Federation or the Government of the Russian Federation.

6. The Ministry of Education and Science of the Russian Federation, in order to exercise powers in the established field of activity, has the right:

6.1. request and receive, in the prescribed manner, information necessary for making decisions on issues within the competence of the Ministry;

6.2. involve, in the prescribed manner, scientific and other organizations, scientists and specialists to study issues within the scope of the Ministry’s activities;

6.3. create coordination, advisory and expert bodies (councils, commissions, groups, collegiums), including interdepartmental ones, in the established field of activity;

6.4. establish, in accordance with the established procedure, print media for the publication of normative legal acts in the established field of activity, official announcements, placement of other materials on issues within the competence of the Ministry and subordinate federal services and federal agencies;

6.5. provide explanations to legal entities and individuals on issues within the scope of the Ministry’s activities;

6.6. adopt normative legal acts on the implementation by government bodies of the constituent entities of the Russian Federation of delegated powers in the field of education, including administrative regulations for the provision of public services and the execution of government functions in the field of delegated powers in the field of education, and also has the right to establish target forecast indicators for the implementation by constituent entities of the Russian Federation delegated powers in the field of education;

6.7. establish, in agreement with the Heraldic Council under the President of the Russian Federation, a heraldic sign - an emblem, flag and pennant of the federal service and federal agency under the jurisdiction of the Ministry;

6.8. establish personal scholarships, determine the amounts and terms of their payment.

7. The Ministry of Education and Science of the Russian Federation in the established field of activity does not have the right to exercise control and supervision functions, except in cases established by federal laws, decrees of the President of the Russian Federation or decrees of the Government of the Russian Federation.

The restrictions on the powers of the Ministry established by the first paragraph of this clause do not apply to the powers of the Minister to resolve personnel issues and issues of organizing the activities of the Ministry and its structural divisions.

When implementing legal regulation in the established field of activity, the Ministry does not have the right to establish functions and powers of federal government bodies, government bodies of constituent entities of the Russian Federation, local self-government bodies, as well as restrictions on the exercise of the rights and freedoms of citizens, the rights of non-state commercial and non-profit organizations, except for cases where the possibility of introducing such restrictions by acts of authorized federal executive bodies is expressly provided for by the Constitution of the Russian Federation, federal constitutional laws, federal laws and those issued on the basis and in pursuance of the Constitution of the Russian Federation, federal constitutional laws, federal laws by acts of the President of the Russian Federation and the Government of the Russian Federation.

III. Organization of activities

8. The Ministry of Education and Science of the Russian Federation is headed by the Minister, appointed and dismissed by the President of the Russian Federation on the proposal of the Chairman of the Government of the Russian Federation.

The Minister bears personal responsibility for the implementation of the powers assigned to the Ministry of Education and Science of the Russian Federation and the implementation of state policy in the established field of activity.

The Minister has deputies who are appointed and dismissed by the Government of the Russian Federation.

The number of Deputy Ministers is established by the Government of the Russian Federation.

9. The structural divisions of the Ministry of Education and Science of the Russian Federation are departments in the main areas of activity of the Ministry. Departments include divisions.

10. Minister:

10.1. distributes responsibilities among his deputies;

10.2. approves regulations on the structural divisions of the Ministry;

10.3. in accordance with the established procedure, appoints and dismisses employees of the Ministry;

10.4. resolves, in accordance with the legislation of the Russian Federation on public service, issues related to the performance of federal public service in the Ministry;

10.5. approves the structure and staffing table of the central apparatus of the Ministry within the limits of the wage fund and the number of employees established by the Government of the Russian Federation, the cost estimate for its maintenance within the limits of the appropriations approved for the corresponding period provided for in the federal budget;

10.6. approves the annual work plan and performance indicators of the federal service and federal agency subordinate to the Ministry, as well as reports on their activities;

10.7. submits to the Government of the Russian Federation, upon proposal from the heads of the federal service and federal agency subordinate to the Ministry, draft regulations on the federal service and federal agency, as well as proposals on the maximum number of employees of the federal service and federal agency and the wage fund of their employees;

10.8. submits to the Government of the Russian Federation in the prescribed manner proposals for the creation, reorganization and liquidation of federal state organizations under the jurisdiction of the Ministry and the federal service and federal agency subordinate to the Ministry;

10.9. submits to the Government of the Russian Federation draft normative legal acts and other documents specified in subclause 5.1 of these Regulations;

10.10. gives the heads of the federal service and federal agency subordinate to the Ministry mandatory instructions;

10.11. suspends, if necessary, decisions of the federal service and federal agency (their heads) subordinate to the Ministry or cancels these decisions, unless a different procedure for their cancellation is established by federal laws;

10.12. appoints and dismisses from office, upon the recommendation of the heads of the federal service and federal agency subordinate to the Ministry, deputy heads of the federal service and federal agency;

10.13. represents, in the prescribed manner, employees of the Ministry and federal services and federal agencies subordinate to the Ministry, other persons operating in the established field, for the conferment of honorary titles and state awards of the Russian Federation, the Certificate of Honor of the President of the Russian Federation, the Certificate of Honor of the Government of the Russian Federation, for encouragement in in the form of an announcement of gratitude from the President of the Russian Federation and the Government of the Russian Federation;

10.14. in accordance with the established procedure, appoints and dismisses heads of subordinate organizations, concludes, changes and terminates employment contracts with these managers;

10.15. establishes and assigns departmental awards and titles to employees of the education system;

10.16. issues orders of a normative nature, and on operational and other current issues of organizing the activities of the Ministry - orders of a non-normative nature.

11. Financing of expenses for the maintenance of the Ministry of Education and Science of the Russian Federation is carried out from funds provided in the federal budget.

12. The Ministry of Education and Science of the Russian Federation is a legal entity, has a seal with the image of the State Emblem of the Russian Federation and with its name, other seals, stamps and forms of the established form, accounts opened in accordance with the legislation of the Russian Federation.

The Ministry of Education and Science of the Russian Federation has the right to have a heraldic sign - an emblem, a flag and a pennant, established by the Ministry in agreement with the Heraldic Council under the President of the Russian Federation.

13. The location of the Ministry of Education and Science of the Russian Federation is Moscow.

Government of the Russian Federation decides:

1. Approve the attached Regulations on the Ministry of Education and Science of the Russian Federation.

2. Establish that the Ministry of Education and Science of the Russian Federation ensures the implementation of powers defined in accordance with this resolution, within the limits established by the Government of the Russian Federation of the maximum number of employees of the Ministry, as well as budgetary allocations provided for the Ministry in the federal budget for leadership and management in the field of established functions.

3. Recognize as invalid the acts of the Government of the Russian Federation according to the list according to the appendix.

1. The Ministry of Education and Science of the Russian Federation (Ministry of Education and Science of Russia) is a federal executive body that carries out the functions of developing and implementing state policy and legal regulation in the field of education, scientific, scientific, technical and innovative activities, nanotechnology, and the development of federal science centers and high technologies, state scientific centers and science cities, intellectual property (with the exception of legal regulation of issues related to control, supervision and provision of public services in the field of legal protection of inventions, utility models, industrial designs, programs for electronic computers, databases and topologies of integrated circuits, including those included in the unified technology, trademarks, service marks, appellations of origin of goods), in the field of education, guardianship and trusteeship of minor citizens, social support and social protection of students of educational organizations, in the field of youth policy, as well as functions for the provision of public services and management of state property in the field of education, upbringing, scientific, scientific-technical and innovative activities, including the activities of federal centers of science and high technology, state scientific centers, unique scientific stands and installations, federal centers of collective use, leading scientific schools, a new generation national research computer network and information support for scientific, scientific, technical and innovative activities.
